​Protection of creations

To protect a trademark, you must file it with the OMPIC.  This process allows you to become the exclusive owner of your trademark. Filing a trademark also allows you to protect yourself against a competitor who would misuse your trademark.

Any natural or legal person, having a domicile or an industrial or commercial establishment in Morocco, may file an application for registration of an industrial design or model. Persons who do not meet this condition may elect domicile with an agent domiciled or having its registered office in Morocco.

The effects of the registration of a mark being territorial and limited, any person wishing to export or develop his activity on foreign markets must first protect his mark at the level of the countries concerned.

If you have already filed a national patent application, you will lose novelty as soon as it is published. However, you have a priority period of 12 months after the date of the first filing, during which only you can file applications in other countries. After this period, you will be able to see your invention used abroad.

The protection of an industrial design or model is territorial. This means that, in general, it is limited to Morocco. Therefore, if you wish to have your industrial design protected in export markets, you will need to ensure that such protection is sought in the countries concerned.
